Terms and Conditions for Scholar Transportation Services
Welcome to our scholar transportation services. These terms and conditions outline the agreement between you (the "Client" or "Parent") and us (the "Service Provider") for the provision of transportation services for scholars. By engaging our services, you agree to be bound by these terms and conditions.
1. Types of Services Provided
We offer two primary types of transportation services for scholars:
- 1.1. Chauffeur Service: This service typically utilizes a 5-seater vehicle, suitable for individual scholars or small, pre-arranged groups. The service is tailored to the specific schedule and route requirements of the Client.
- 1.2. Shuttle Service: This service commonly employs vehicles with larger capacities, such as 7-seaters, 9-seaters, or 15-seater buses. The Shuttle Service operates on pre-defined routes and schedules that accommodate multiple clients.
2. Pricing
The rates for both Chauffeur and Scholar Shuttle services are variable and will be determined based on the specific details of your transportation requirements, including but not limited to distance, frequency of service, number of scholars, and specific route needs. Detailed pricing will be provided upon consultation and agreement.
3. Service Distinctions
It is important for Clients to understand the distinctions between our service offerings:
- 3.1. Chauffeur Service: This is a more personalized service where the schedule and route are determined by the Client's individual needs.
- 3.2. Scholar Shuttle Service: This is a shared service. Clients signing up for the Scholar Shuttle Service acknowledge and agree that the daily schedule, routes, and pick-up/drop-off times are established based on the locations and schedules of all clients utilizing that particular shuttle route. The Shuttle Service does not offer the same level of individualized scheduling flexibility as the Chauffeur Service. Clients must be aware of and adhere to the daily route and times, which are influenced by the destinations of other individuals on the same route.
4. Liability
- 4.1. Service Provider Liability: We are committed to the safety of our passengers and will take all reasonable measures to ensure a safe journey. Our liability for passenger safety is subject to the terms outlined herein and applicable laws.
- 4.2. Exclusion of Liability: The Service Provider shall not be held liable for delays, failures, or damages resulting from circumstances beyond our reasonable control. These circumstances include, but are not limited to:
- Acts of God (e.g., extreme weather conditions, natural disasters).
- Client or scholar personal negligence or misconduct.
- Unforeseen traffic conditions, road closures, accidents not caused by the Service Provider.
- Actions of third parties not under the direct control of the Service Provider.
- Delays caused by school authorities or changes in school schedules not communicated in a timely manner.
5. Collection and Drop-off Procedures
5.1. Morning Collection:
- 5.1.1. Readiness: The Client is responsible for ensuring that the scholar is ready at the designated departure point at least ten (10) minutes prior to the agreed-upon collection time.
- 5.1.2. Waiting Time: In the event a scholar is not ready at the scheduled arrival time of the vehicle, the driver will wait for a maximum of five (5) additional minutes.
- 5.1.3. Departure: If, after the five (5) minute grace period, the scholar is still not ready or causes further delays, the vehicle will depart to continue its allocated route to avoid inconveniencing other clients.
- 5.1.4. Flexible Collection Times: The Client acknowledges that morning collection times are provided as a guideline and are not fixed. Factors such as route absenteeism, school term changes, and the addition of new scholars to the route may necessitate adjustments to collection times, resulting in earlier or later pick-ups. The Service Provider will endeavor to communicate significant changes.
5.2. Afternoon Collection:
- 5.2.1. Potential Delays: The Client should anticipate potential delays of thirty (30) minutes to one (1) hour after the agreed-upon scholar collection time from school. These delays can be due to traffic congestion, unforeseen road incidents, or other factors beyond our immediate control.
- 5.2.2. Communication of Delays: While Serrao Bambinos Trans Shuttle Service (or "the Service Provider") will endeavor to inform Clients of significant delays, the Client acknowledges that it may not always be possible to provide immediate notification for every delay. Serrao Bambinos Trans (or "the Service Provider") will strive to ensure arrival within the anticipated delay window.
- 5.2.3. Exam Periods and School Time Changes: During examination periods or instances where the school alters its dismissal times, the potential delay for collection may extend up to two (2) hours, depending on the distance the vehicle needs to cover and the logistical adjustments required. Scholar transport rotation during such periods will be structured to collect children based on their revised finishing times.
- 5.2.4. Scholar-Caused Delays at Departure Point: If a scholar causes a delay in departing from the school's collection point for any reason, exceeding a maximum of ten (10) minutes waiting time after being requested to accompany the driver, the scholar may be reallocated to the next available shuttle time. In such cases, if no further vehicle is available for that route or school on that day, the Parent will be informed and will be responsible for arranging the scholar's collection.
- 5.2.5. Familiarization with Procedures: The Client agrees to familiarize themselves and ensure the scholar is familiar with the collection procedure times and shuttle service schedules. Scholars are expected to wait patiently and safely at the designated school premises until their scheduled collection time.
6. Amendments to Terms and Conditions
The Service Provider reserves the right to amend these terms and conditions at any time. Clients will be notified of any significant changes. Continued use of the service after notification of changes will constitute acceptance of the new terms and conditions.
7. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.
By utilizing our scholar transportation services, you confirm that you have read, understood, and agree to these Terms and Conditions.
